Who is liable when products fail or private information is disclosed? Looking at current consumer privacy and data security class action cases, this session will address the current liability regime, including the potential applicability of federal exemptions and safe harbors, and what companies can do to mitigate their risks. It will also address basic causation and liability issues and potential safe harbors and immunities when IoT products fail, including whether IoT creates the conditions in which software and data are subject to products liability claims.
