E-discovery: Data Production Process [01:00:24]
  • Protective orders and privilege clawback: The norms of protective orders (aimed at confidentiality protection), and the related question of agreements/court orders that permit return (“clawback”) of privileged documents that may be inadvertently produced will be explored.
  • Dealing with metadata: The unique questions of metadata, including when metadata must be produced, and the problem of production of documents in wholly electronic form will be examined.
  • Inaccessible media and cost-shifting: The question of when electronic information may be considered inaccessible (such that it need not be produced), and whether, in some circumstances, the costs of search and production of data may be shifted to the requesting party will be considered.
