  • Litigation holds: The scope of preservation obligations, when the duty to preserve arises and the period for preservation and will be discussed.
  • Identification of custodians and locations: The means to determine who the “key players” in the litigation may be and where essential information resides will be identified.
  • Forms of litigation holds: The variety of acceptable litigation holds, including “hold in place” and selective searching/retention, as well as the written forms of notice for a litigation hold will be reviewed.
