The use of visual content has never more pervasive than in this era of digital publishing and “technotainment”. The abundance of visual content, however, has many traps for the unwary. The ease of merely dragging and copying images from one site to another may leave digital publishers exposed to liability under copyright law or other claims. This program will look at the current best practices in acquiring and using visual content in this digital environment. Topics will include recent cases involving the use of framing or embedding of content and whether such practices are infringing; when one can rely on fair use; the risk of using social media content, free content or content with Creative Commons licenses and understanding what is really in the public domain. In addition the program will look at the increased use of image tracking services by content owners to enforce copyright and what steps should be taken if you receive a claim to reduce your exposure.
